Our Employment Law Services
Our barristers are often the first port of call when a contentious matter arises in the workplace. We assist both employers and employees in internal investigations and grievance procedures, disciplinary hearings, employee consultations and legal proceedings before all jurisdictions in Mauritius.
Contracts & Policies
Draft and review of all employment-related documentation, including fixed-term contracts, homeworking agreements, flexitime policies, performance management procedures, data protection handbooks, grievance and whistleblowing procedures, social media policies, etc.
Remuneration is a core element of the employment relationship. We advise employers on tax-efficient benefits and structures that enhance employee retention, such as employee share schemes, bonuses, long-term savings or investment incentives, loans, etc. We assist in application for regulatory approvals where needed.
M&A / Restructuring
We advise employers on the procedural requirements to restructure their workforce, whether as a result of mergers and takeovers or internal reorganisations for business efficiency. The Chambers advises on redundancies, promotions and change of roles, amendments to contractual terms and policies, transfer of accrued benefits, etc.
Setting up of private pension schemes, including the application for approval by the Financial Services Commission, the drafting and review of rules governing the scheme, incorporation of contractual terms in employment contracts, and advice on issues that arise in the management and supervision of the schemes.
We regularly host training workshops for management and HR professionals. We have delivered training to more than 200 employers in collaboration with Adecco Mauritius on the new financial provisions of the Workers’ Rights Act 2019, employers’ retirement benefit obligations, and the implications of COVID-19 for employers.
